The Evolution of Turkish Competition Law – Close to European Law?

April 2014Kinstellar Istanbul Senior Associate Çağrı Çetinkaya authored an article entitled “The Evolution of Turkish Competition Law – Close to European Law?” published in the Journal of European Competition Law & Practice (2014).

The full text of the article is available to subscribers here, while registered users may purchase a short-term access. Here is the abstract:

“Turkish competition law has developed on the basis of and is materially similar to European law but also demonstrates a notable tendency towards autonomy in certain areas.

For instance, Turkish competition law has not yet embraced the European evolution as regards the assessment of merger control or the elimination of clearance decisions in the application of prohibitions on anticompetitive agreements.

In other areas, it has moved more quickly and gone further than EU law — for instance by deciding that fines can be imposed on employees.”
