Kinstellar Partners speak at Ethics & Anti-Corruption conference in Prague

March 2017 - Jitka Logesová, Partner at Kinstellar’s Prague office and head of the firm-wide Compliance, Risk and Sensitive Investigation practice, and Kostiantyn Likarchuk, Partner in the Kyiv office and head of the firm-wide Dispute Resolution practice, spoke at the 8th “Business Ethics Anti-corruption Compliance & Fraud Prevention Strategies in CEE, SEE & CIS” conference in Prague.

Recent experience from across Central and Eastern Europe indicates that companies are becoming ever more vigilant, putting greater emphasis on implementing effective anti-corruption policies. This trend results from recent regulatory developments at both the EU and national levels, as well as from the steady upturn in anti-bribery enforcement activities.

Jitka and Kostiantyn spoke about the current state of anti-corruption enforcement in Central and Eastern Europe and future trends. Jitka focused on general trends, such as increased prosecution of companies, the establishment and development of specialised anti-corruption bodies, the implementation of compliance police (and in this respect, the practical use of the new ISO on best anti-corruption practices). She also mentioned certain aspects that might, in some cases, be bogging down enforcement activities. She discussed the most common issues that would trigger a state investigation and the most exposed sectors, illustrating these issues with a case study on international criminal cooperation.

Kostiantyn followed up using the current situation in Ukraine – two years after the launch of a major anti-corruption reform in the country – to look at other ways anti-corruption authorities are addressing the problem. He also took participants through the process of implementing reforms and the related challenges and touched on some of the more landmark cases.
