Kinstellar lawyers participate in two high-profile international arbitration events in Kyiv

November 2016 - The beginning of November proved fruitful for the field of international arbitration in Ukraine. Kinstellar lawyers participated in two prominent events in connection with the conference “Kyiv Arbitration Days 2016: Think Big!” organised by the Ukrainian Bar Association.

A day before the conference, on 2 November 2016, Mykyta Nota, Managing Associate in Kinstellar’s Kyiv office, participated in the panel discussion “Light in the Tunnel of Ethics? Regulation of Counsel Conduct in International Arbitration” at an event jointly organised by the International Chamber of Commerce Young Arbitrators Forum; the International Centre for Dispute Resolution Young & International; the Ukrainian Arbitration Association; and the Young International Arbitration Group of the London Court of International Arbitration.

At the event, Mykyta moderated a debate among fellow panellists concerning whether only counsel admitted locally under applicable law should be allowed to represent clients in international arbitration. Panellists were rated on their answers by the audience and a jury that included Ivana Blagojević of the ICC, Maksim Kodunov from Ukraine’s Ministry of Justice, and Svetlana Romanova of Metinvest Holding, one of the largest CIS producers of iron ore raw materials and steel.

The following day, on 3 November, Kostiantyn Likarchuk, Partner in Kinstellar’s Kyiv office and the head of the firm-wide Dispute Resolution practice, spoke at "Kyiv Arbitration Days 2016.”

The conference, which brings together world-class dispute resolution practitioners and prominent arbitration experts to Kyiv to discuss and share the hot issues and latest trends in international arbitration, proved to be an excellent opportunity for leading international arbitration experts to meet and share experiences with their peers from around the world. Among the speakers at the conference were highly esteemed world experts in dispute resolution from Germany, Austria, the US, the UK, France, Poland and Ukraine.

Kostiantyn’s speech, delivered during the conference’s fourth session entitled “Show me the money” focused on third-party funding, enforcement issues, and decision-making strategies in international arbitration. In his speech he described various enforcement options in Emerging Europe and Central Asia, having highlighted the key developments in Ukraine.
