Kinstellar successfully defends a leading European low-cost airline in Ukraine

July 2018 – Kinstellar successfully defended a leading European low-cost carrier in Ukrainian commercial courts against Danylo Halytskyi Lviv International Airport. A claim brought by the airport at the request of the State Audit Service of Ukraine sought to deprive the low-cost operator’s Ukrainian subsidiary of airport fee discounts granted in 2014–2015.

The claimant moved to invalidate the relevant provisions of the Standard Ground-Handling Agreement with retrospective effect and sought payment by the airline of additional fees and charges. Oleksiy Burchevskyy, Head of the Aviation Sector at Kinstellar’s Kyiv office, successfully argued the case for the airline in commercial courts of the first and appellate instances, setting up an important precedent for similar disputes between state-run airports and aircraft operators. “The successful resolution of the case in favour of the airline reconfirms the fundamental right of airlines to receive airport discounts in accordance with Ukrainian law and will hopefully attract more international carriers to the Ukrainian market,” comments Oleksiy Burchevskyy, who regularly advises clients on state-regulated rates at Ukrainian airports.
